| 04/03/2026 | MINUTE entry before the Honorable Matthew F. Kennelly: The plaintiff (which is located in China) has sued a number of entities for trademark infringement. The defendants are all likely located overseas. The Court entered an order questioning the existence of personal jurisdiction in this case. In response plaintiff has provided screenshots showing that the defendants' online stores would accept orders for delivery to Illinois. But there are no actual completed deliveries or even confirmed sales. In other words it appears that plaintiff's representative or investigator typed in a Chicago address on an online order form to see if it would work but then stopped there and did not complete the purchase. That is not enough for personal jurisdiction in Illinois. In response to the order to show cause plaintiff asks to conduct discovery to ascertain whether any of the defendants made Illinois sales. That puts the cart before the horse. It is relatively common in cases of this type for plaintiff's counsel (typically via an investigator) to make actual purchase and obtain delivery in Illinois before filing suit. It's not that hard to do. The showing of personal jurisdiction in the present case is deficient. The Court directs the Clerk to enter judgment stating: This case is dismissed for lack of personal jurisdiction. Plaintiff is reminded that if it refiles this case or any part of it later it must designate the new case(s) on the civil cover sheet as a refiling of the present case. See Local Rule 40.3(b)(2). Plaintiff has also filed a motion for electronic service and for a temporary restraining order. But although the materials that plaintiff attached to the motion reflect that the defendants' internet-based stores would take orders from Illinois residents, as best as the Court can tell from the attachments plaintiff has not identified any actual sales into Illinois or even confirmations of sales to Illinois addresses. The Court therefore orders plaintiff to show cause in writing by 4/8/2026 why the case should not be dismissed for lack of personal jurisdiction.
