| 03/16/2026 | PAPERLESS ORDER Striking Motions and Requiring Informal Settlement Conference. On March 14, 2026, Defendants Cherish Cheer and Lullaby Nice filed a Motion to Dismiss Plaintiff's Complaint Pursuant to Fed. R. Civ. P. 12(b)(2) and 12(b)(6), [ECF No. 30], and Defendants Signature Inner, Blue Lake Outdoor, and Freshmart filed a Motion to Dismiss Plaintiff's Complaint Pursuant to Fed. R. Civ. P. 12(b)(2) and 12(b)(6), [ECF No. 31] (together, "Motions"). Southern District of Florida Local Rule 5.1(a)(5) requires that all civil motions must "[i]nclude a caption with" accurate identifying information including the docket number, the assigned District Judge, and the style of the action. See Local Rule 5.1(a)(5). The Court's review of the Motions indicates that the case caption cites a different case that is not before this Court, The Galleon Guild Ltd. v. The Partnerships, Unincorporated Associations Identified on Schedule A, Case No. 25-cv-25298-FAM. Accordingly, the Motions, [ECF Nos. 30, 31] are hereby STRICKEN. Further, on or before April 17, 2026, the parties shall conduct an informal settlement conference for a minimum of two (2) hours. A representative with settlement authority must attend the informal settlement conference or be available telephonically. The parties shall file a Joint Notice of Compliance and Status Report certifying compliance with this Order and providing a report on the status of discussions on or before 5:00 P.M. on April 17, 2026. Should the parties reach a resolution of this case through meeting and conferring prior to conducting the informal settlement conference, the parties shall promptly notify the Court that the informal settlement conference will no longer be necessary. To the extent that Defendants seek to refile the same or similar motions with a correct caption, they are only permitted to do so after a Joint Notice of Compliance has been filed, indicating that the parties have conducted an informal settlement conference. And given that the Motions appear to present overlapping issues of law and fact, Defendants are directed to file a single consolidated Motion to Dismiss, if necessary, after conducting their informal settlement conference.
