10/26/2025 MINUTE entry before the Honorable Franklin U. Valderrama: Before the Court is Plaintiff's memorandum in support of joinder of over 100 Defendants [15]. Plaintiff claims joinder is proper because "[t]he Defendants here share more than simply infringing the same Works; the evidence available to the Plaintiff at this juncture suggests that many of the online sellers share a number of operative facts: potential common ownership of accounts, common geographic operations, similar methodology in operation, and similar channels of securing counterfeit goods[.]" R. 15 at 7. For the reasons stated in the Court's order dismissing this case for misjoinder [12], these reasons are insufficient to establish the propriety of joinder. See also Toyota Motor Sales, 24-cv-09401 Dkt. 23 at 3 (analogizing Schedule A Defendants to vendors outside of a concert selling counterfeit t-shirts: "These vendors had the same profile. They sold the same merchandise. They used the same tactics to try to get attention. Two of them even offered similar deals ('two for $30'). One could even argue that they 'swarmed' the concert venue that evening. But that does not establish a logical relationship between them," "even if the t-shirts came from the same factory, and even if the unauthorized vendors employed the same hustle.") (cleaned up). And although Plaintiff argues that it will be more economical for the Court to allow joinder here, the Court cannot circumvent the requirements of Federal Rule of Civil Procedure 20 for its own convenience. Accordingly, Plaintiff's complaint remains dismissed without prejudice for misjoinder. By 11/07/2025, Plaintiff shall file an amended complaint naming one defendant. If Plaintiff's amended complaint names more than one defendant, Plaintiff must submit a memorandum along with sufficient documentary evidence in support of joinder under Rule 20. Mailed notice.
