| 08/02/2025 | MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff has filed a motion for entry of default judgment. The motion, however, does not provide any information regarding the nature, character, or extent of the claimed infringement by the defendants. Without this, it is virtually impossible for the Court to set an appropriate statutory damages award. Generally, in cases of this nature, when this situation arises the Court can look back to the motion for TRO and/or the motion for preliminary injunction, to which evidence regarding these topics is typically attached. But in this case plaintiff did not move for a TRO or a preliminary injunction. Plaintiff is directed to supplement its motion by 8/6/2025 to include information of the type sought by the Court, on a defendant-by-defendant basis. The Court will leave it to plaintiff to determine the appropriate format for this, but a spreadsheet of some sort likely would do. Going forward, the Court would prefer information along these lines to be presented along with and as part of any default judgment motion filed by plaintiff's counsel's firm in cases of this type. |
