Cummings; and It further appearing that Judge Cummings and Judge Hunt have agreed that 23 CV 3584, Vista Outdoors Operations, LLC v. The Individuals, Corporations, Limited Liability Companies, Partnerships, and Unincorporated Associations Identified on Schedule A Hereto, be reassigned to Judge Hunt; therefore It is hereby ordered that 23 CV 3584, Vista Outdoors Operations, LLC v. 10/26/2023 | GENERAL ORDER 23-0040: EXECUTIVE COMMITTEE ORDER: IT APPEARING THAT, the civil cases on the attached list have been selected for reassignment to form the initial calendar of the Honorable Jeffrey I. Cummings; therefore IT IS HEREBY ORDERED that the attached list of 290 cases be reassigned to the Honorable Jeffrey I. Case reassigned to the Honorable Jeffrey Cummings for all further proceedings. Honorable LaShonda A. Hunt no longer assigned to the case. Signed by Honorable Rebecca R. Pallmeyer on 10/26/23. |
10/20/2023 | DEFAULT FINAL JUDGMENT ORDER Signed by the Honorable LaShonda A. Hunt on 10/20/23. Emailed notice. |
10/20/2023 | MINUTE entry before the Honorable LaShonda A. Hunt: No remaining Defendant has responded to Plaintiff's motion for entry of default judgment. Accordingly, the motion 50 is granted. Based on the evidence previously submitted by Plaintiff and the admission of liability by virtue of the default, Plaintiff has established that a permanent injunction should be entered. The infringement of Plaintiff's marks irreparably harms Plaintiff and confuses the public. Because this infringement was willful and considering the value of Plaintiff's brand as well as the need to deter infringement that is easily committed and difficult to stop, the Court concludes that $50,000 is an appropriate award of statutory damages against each remaining defendant. Enter Final Judgment Order as to all Defendants except Defendant No. 6 (easygoing4) and Defendant No. 7 (Gocamping Store). Emailed notice. |
10/17/2023 | MINUTE entry before the Honorable LaShonda A. Hunt: Defendants' Motion for Extension of Time 61 is granted. Defendants Gocamping Store and easygoing 4 are ordered to file their responses to Plaintiff's complaint by 11/6/23. Emailed notice. |

All remaining defendants except Defendant No. 6 (easygoing4) and Defendant No. 7 (Gocamping Store) have failed either to plead or to otherwise appear to defend against this action. Accordingly, default against all defendants on Amended Schedule A except Defendant Nos. 6 and 7, is entered under Rule 55(a) of the Federal Rules of Civil Procedure. Any objections to the motion for entry of default judgment by the defaulted Defendants must be filed on or before 10/12/23. If no objections are filed by that date, the Court will consider the motion unopposed. Plaintiff is ordered to file the Amended Schedule A by 9/26/23. Going forward, Plaintiff should ensure that the relevant list of affected Schedule A defendants is filed on the docket with the default motion, and not just emailed to the Court as an attachment to the proposed default/default judgment order. 08/08/2023 | MINUTE entry before the Honorable LaShonda A. Hunt: Motion hearing held telephonically. Defendants failed to appear or object in advance. For the reasons previously stated on the record, the Court finds that the grounds for entry of a preliminary injunction have been satisfied here. Counsel is to submit an updated proposed order. The remaining defendants have an answer deadline of 8/17/23 38. Plaintiff is ordered to file any motions for entry of default pursuant to Federal Rule of Civil Procedure 55(a) by 9/18/23. 07/31/2023 | MINUTE entry before the Honorable LaShonda A. Hunt: Plaintiff's Motion for Entry of a Preliminary Injunction as to Defendant Nos. 4-16 and 53-86 34 is taken under advisement. A telephonic motion hearing is set for 8/8/23, at 10:15 AM. Attorneys/parties should appear for the hearing by calling the Toll-Free Number: 877-336-1828, Access Code: 4082461. Members of the public and media will be able to call in to listen to this hearing. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting court proceedings. The motion may be considered unopposed as to any Defendant who does not file an objection by 8/7/23 or appear at the telephonic hearing. For the reasons stated in the Court's orders initially entering the TRO, and then extending the TRO, the TRO is extended to and including the date the Court adjudicates the motion for a preliminary injunction. See H-D Mich., LLC v. Hellenic Duty Free Shops S.A., 694 F.3d 827, 843-45 (7th Cir. 2012). Because this extension exceeds the maximum duration for a TRO under Fed. R. Civ. P. 65(b), this extension "becomes in effect a preliminary injunction that is appealable, but the order remains effective." Id. at 844. Plaintiff must serve a copy of this minute order upon all affected Defendants within one business day of its entry on the docket and promptly file proof of that service. Emailed notice. |

07/27/2023 | MOTION by Plaintiff Vista Outdoor Operations, LLC for preliminary injunction Plaintiff's Motion for Entry of a Preliminary Injunction as to Defendant Nos. 4-16 and 53-86 |
07/27/2023 | MINUTE entry before the Honorable LaShonda A. Hunt: The Court previously scheduled Plaintiff's motion for entry of a preliminary injunction 26 for an in-person hearing on 7/27/23 32. Although Plaintiff was ordered to promptly serve that minute order providing affected defendants with notice of the 7/25/23 deadline to object as well as the hearing information, and to file proof of that service, Plaintiff has not certified its compliance with those requirements. The Court is unwilling to grant further preliminary injunctive relief without the proper certification. Therefore, the 7/27/23 in-person motion hearing is stricken and reset to a telephonic motion hearing on 8/1/23, at 10:30 AM. Attorneys/Parties should appear for the hearing by calling the Toll-Free Number: 877-336-1828, Access Code: 4082461. Members of the public and media may call in to listen to the hearing. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting court proceedings. Plaintiff must serve this minute order on the affected defendants by 7/27/23 and promptly file proof of that service. Failure to do so may result in the motion being denied and the TRO against these defendants dissolved. Emailed notice. |
07/19/2023 | MINUTE entry before the Honorable LaShonda A. Hunt: Plaintiff's motion for entry of a preliminary injunction 26 is taken under advisement. An in-person hearing on the motion is set for July 27, 2023, at 10:45 AM in Courtroom 1219. Any objections to the motion must be filed on or before July 25, 2023. The motion may be considered unopposed as to any Defendant who does not file an objection. R. Civ. P. 65(b), this extension "becomes in effect a preliminary injunction that is appealable, but the order remains effective." Id. at 844. Plaintiff must serve this minute order upon all affected Defendants within one business day of its entry on the docket and must promptly file proof of that service. Emailed notice. |
07/19/2023 | MINUTE entry before the Honorable LaShonda A. Hunt: Plaintiff's Ex Parte Motion to Extend the Temporary Restraining Order as to Defendant Nos. 4-16, 53-86 and 92-93 25 is granted for good cause shown. As to these defendants only, the TRO is extended to 7/27/23. Because this extension exceeds the maximum duration for a TRO under Fed. R. Civ. P. 65(b), this extension "becomes in effect a preliminary injunction that is appealable, but the order remains effective." See H-D Mich., LLC v. Hellenic Duty Free Shops S.A., 694 F.3d 827, 844 (7th Cir. 2012). Nevertheless, Plaintiff is required to file and serve a separate motion for preliminary injunction as to any of these Defendants at least 2 business days prior to the expiration of the extended TRO.
