Hunt: Plaintiff's Motion for Leave to Conduct Expedited Third-Party Discovery 11 is denied, and the late-filed supplement 18 is stricken as untimely. At the in-person presentment hearing on 4/25/25, the Court outlined the many deficiencies with this case--misjoinder of defendants and pointed out the unsupported conclusory allegations in the motions. Although Plaintiff's lead counsel scheduled the hearing for that day 16, she did not bother to attend herself. Instead, she sent substitute counsel who promised to promptly relay all these concerns. At that point, the Court could have, and likely should have, just denied the motion and remedied the misjoinder. Instead, Plaintiff was granted an opportunity to supplement the motion by 5/15/25. But his counsel waited until the due date to file a motion--unaccompanied by the required notice of presentment--complaining that she had just received the transcript from the hearing and needed more time to respond. And so the Court granted counsel's requested extension to 5/22/25. But Plaintiff then took an extra day for his filing--until 5/23/25 at 5:08PM--without seeking leave, which this Court did not and will not allow. And in the belated response, Plaintiff feigns ignorance of the Court's rulings on joinder, when in fact his counsel is a repeat filer of these Schedule A cases and fully aware of this Court's longstanding position. See Viking Arm AS v. P'ships & Unincorporated Ass'ns Identified on Schedule A, No. 24 C 1566, 2024 WL 2953105, at *3 (N.D. Ill. June 6, 2024). For all those reasons, Defendant numbers 2 and 3 are dismissed without prejudice for improper joinder under Fed. R. Civ. P. 20. This case will proceed as to Defendant 1 only. The Clerk is directed to update the docket to reflect that the only defendant is "JewelireShop" and to unseal all previously sealed documents at 4 and 8 in accordance with this Court's order dated 4/25/25 14. The parties shall file a joint status report for new case by 7/1/25. A template for the report can be found on Judge Hunt's webpage under "Initial Status Conference and Status Report."
