| 03/13/2025 | MINUTE entry before the Honorable John J. Tharp, Jr: Upon review of the plaintiff's supplement to its motion for a temporary restraining order [16], the Court notes that several of the listings the plaintiff alleges infringe his copyrights are no longer active. To obtain injunctive relief, a plaintiff must "demonstrate that he faces a real and immediate threat of future injury; a past injury alone is insufficient to establish standing for purposes of prospective injunctive relief." Carello v. Aurora Policemen Credit Union, 930 F.3d 830, 833 (7th Cir. 2019) (cleaned up). The Court does not see how past infringement by defendants entitles the plaintiff to a temporary restraining order against those defendants. By 3/20/2025, the plaintiff must either file a supplemental brief explaining why defendants who no longer have listings actively infringing on the plaintiff's copyright pose a "real and immediate threat" to the plaintiff's copyrights and why money damages could not adequately compensate the plaintiff for any past injuries, or amend the motion for a temporary restraining order to omit defendants no longer actively infringing on the plaintiff's copyrights.
