Accordingly, the motion 22 is granted. Based on the evidence previously submitted by Plaintiff and the admission of liability by virtue of the default, Plaintiff has established that a permanent injunction should be entered. The infringement of Plaintiff's intellectual property rights irreparably harms Plaintiff and confuses the public. Because this infringement was willful, and after considering the value of Plaintiff's brand, the low price-point of the infringing products, and the need to deter infringement that is easily committed and difficult to stop, the Court concludes that $5,000 is an appropriate award of statutory damages against each Defaulting Defendant. Enter Final Judgment Order, as modified by the Court. Civil case terminated. |

| 03/25/2025 | MINUTE entry before the Honorable Georgia N Alexakis: Before the Court is plaintiff's motion for entry of default and default judgment 22 against the remaining defendants identified in Amended Schedule A 16. All remaining defendants have failed either to plead or to otherwise appear to defend against this action. Accordingly, default against all defendants on Amended Schedule A is entered under Rule 55(a) of the Federal Rules of Civil Procedure. Upon review of the complaint, the Court sua sponte raises the propriety of joining 162 defendants in a single action. By 2/10/25, plaintiff must file a supplemental memorandum addressing the propriety of joinder in light of the principles described in Estee Lauder Cosmetics Ltd. v. Schedule A, 334 F.R.D. 182 (N.D. Ill. 2020). Plaintiff's memorandum should also address this Court's order in Bug Art Limited v. The Partnerships, 24 CV 7777, Dkt. 28 and Yi Pu (Tianjin) Intelligent Technology Co., Ltd. v. Gyroor et al, 25 CV 81, Dkt. 19, as well as other orders in this District expressing similar joinder-related concerns in cases of this size, including but not limited to Zaful (Hong Kong) Limited v. The Partnerships, 24 CV 11111, Dkt. 12; Toyota Motor Sales, USA, Inc. v. The Partnerships, 24 CV 9401, Dkt. 27; Xie v. The Partnerships, 24 CV 9791, Dkt. 14; and Bailie v. The Partnerships, 24 CV 02150, 2024 WL 2209698 (N.D. Ill. May 15, 2024). In the alternative, plaintiff has leave to file an amended complaint and Amended Schedule A by 2/10/25 with a smaller subset of defendants along with a memorandum explaining why each defendant is properly joined to the others.
