In their forthcoming 12/5/25 status report, the parties are directed to advise the Court whether settlement has been reached and if, not, to propose a short schedule to reset claim-construction briefing. With respect to their request for a settlement conference, the parties have requested not just a referral to Magistrate Judge Gilbert for a settlement conference but an order directing that the settlement conference take place on one of two proposed dates in December 2025 and that the settlement conference take place telephonically. The Court cannot grant this relief. If the parties want Magistrate Judge Gilbert's assistance with a settlement conference, they may request such a referral, but the Court will not dictate that a settlement conference take place on a date certain or via telephonic means. In its most recent status report, plaintiff reports that, according to third-party Amazon, "all Defendants received a notice from Amazon in largely the same manner as the notice received by Defendant Funtouch and filed at dkt. [39-1]" 47. In light of this report from plaintiff, the Court grants Defendant Funtouch's motion to unseal the case 39 and denies plaintiff's motion for leave to file a certain document under seal 31. Plaintiff previously argued that sealing certain documents was "necessary to prevent the Defendants from learning of these proceedings prior to the execution of the temporary restraining order" 4 ; 31. Through third-party Amazon's actions, however, "all defendants" already have learned about these proceedings 47. The Court therefore sees no remaining reason to keep any documents in this matter under seal, nor does plaintiff advance any. The Clerk is therefore directed to unseal all documents in this matter. No further status reports from plaintiff on the topic of Amazon's notice to defendants is necessary. |

Defendant Funtouch's response to the motion for a temporary restraining order is due by 2/6/25; plaintiff's reply due by 2/10/25. A hearing on the motion is set for 2/11/25 at 9:30 a.m. in person. By 2/6/25, plaintiff must also file a supplemental memorandum addressing the propriety of joinder in light of the principles described in Estee Lauder Cosmetics Ltd. v. The Partnerships & Unincorporated Associations Identified on Schedule A, 24 C 1566, 2024 WL 2953105, at *3 (N.D. Ill. June 6, 2024); and Bailie v.
