| 10/29/2025 | MINUTE entry before the Honorable Jeffrey I Cummings: Before the Court is plaintiff's motion for entry of a preliminary injunction [24]. In connection with that motion, plaintiff must serve all remaining defendants with the following statement: "The Court has taken the motion for a preliminary injunction under advisement and will consider the motion unopposed if no defendant appears and objects by or before November 12, 2025." If no objections are filed by that date, the Court will consider the motion unopposed. Plaintiff must serve this minute order upon all remaining defendants within one business day of its entry on the docket and must promptly file proof of that service. For the reasons stated in the Court's order entering the TRO, the TRO is extended to and including the date upon which the Court adjudicates the motion for a preliminary injunction. See H-D Mich., LLC v. Hellenic Duty Free Shops S.A., 694 F.3d 827, 843-45 (7th Cir. 2012). Because this extension exceeds the maximum duration for a TRO under Fed.R.Civ.P. 65(b), this extension "becomes in effect a preliminary injunction that is appealable, but the order remains effective." Id. at 844. In light of this order, plaintiff's motion to extend the TRO [23] is terminated as moot. The 11/5/25 joint status report deadline is stricken. The evidence submitted by plaintiff shows a likelihood of success on the merits (including evidence of active infringement and sales into Illinois), that the harm to plaintiff is irreparable, and that an injunction is in the public interest. An injunction serves the public interest because of the consumer confusion caused by counterfeit goods, and there is no countervailing harm to defendants from an order directing them to stop infringement. Electronic service of process does not violate any treaty and is consistent with due process because it effectively communicates the pendency of this action to defendants. | 09/10/2025 | MINUTE entry before the Honorable Jeffrey I Cummings: The Court has reviewed plaintiff's motion to transfer 11, in which plaintiff maintains that this case should be transferred to Judge Valderrama based on the prior dismissal of defendant Lp Direct in a case before him involving the same plaintiff, Milwaukee Electric Tool Corporation v. Schedule A, Case No. 25-cv-6491. Although plaintiff represents that Judge Valderrama "routinely requires plaintiff[s] in Schedule A cases to sever down to one (1) defendant," there is no indication that Judge Valderrama issued such an order here or otherwise dismissed defendant Lp Direct without prejudice in that matter. Instead, plaintiff amended the complaint on its own accord. As such, there does not appear to be a basis to transfer this case under Local Rule 40.3(b)(2), which allows for direct assignment "[w]hen a case is dismissed with prejudice or without." Moreover, although plaintiff represents in its 9/4/25 status report that Case No. 25-cv-6491 remains pending before Judge Valderrama, this Court's review of the docket indicates that plaintiff voluntarily dismissed that case on 8/20/25. For all of these reasons, plaintiff's motion to transfer 11 is denied and the case will proceed before this Court. Plaintiff's previously filed motion to seal 8 is granted. On or before 11/5/25, the parties shall file a joint initial status report in accordance with the template available on the Court's website under the case management procedure titled "Initial Status Report for Newly Filed Cases." The parties shall also review all of the case management procedures and standing orders available on the Court's website, including the Court's case management procedure for motions to dismiss. Initial tracking status hearing set for 11/17/25 at 9:00 a.m. to track the case only (no appearance is required and the case will not be called).
