09/10/2025 MINUTE entry before the Honorable Franklin U. Valderrama: Plaintiff's motion for extension of the temporary restraining order (TRO) 32 is granted in part. Plaintiff requests that the TRO be extended to 09/30/2025, for a total of 34 days, beyond the 28-day time period provided by Fed. R. Civ. P. 65(b)(2). Plaintiff makes this request because, if extended to 28 days, the TRO would expire on 09/24/2025. However, pursuant to the Court's current deadlines, the earliest a preliminary injunction can issue is 09/30/2025. In other words, Plaintiff seeks to avoid any temporal gap between the expiration of the TRO and the issuance of a preliminary injunction. The Court declines Plaintiff's request because, as will be explained, any gap between the TRO's expiration and the issuance of a preliminary injunction may be fairly attributed to Plaintiff's delay in serving Defendant. The Court thus extends the TRO to the 28-day maximum, until 09/24/2025. However, to lessen the gap between the expiration of the TRO and the issuance of a preliminary injunction, the Court strikes the deadlines set in 30. That is, the Court will now consider Plaintiff's motion for preliminary injunction unopposed if Defendant fails to appear and object by 9/24/2025. This is the earliest deadline the Court may set here, as 09/24/2025 is the date by which Defendant must answer or otherwise respond to Plaintiff's complaint. See R. 29 (certifying that, although the Court granted Plaintiff's motion for electronic service on 08/22/2025, Plaintiff did not serve Defendant via email until 09/03/2025). Plaintiff is directed to file a status report on 09/25/2025 as to whether the preliminary injunction is opposed. Plaintiff must serve this minute order upon Defendant within one business day of its entry on the docket and must file proof of that service within two business days after service. Mailed notice.
