The motions are taken under advisement and now denied without prejudice. Plaintiff's submissions do not persuasively establish a likelihood of success given that the one-word trademark, sirenhead, is different than the accused products' use of the two-word name Siren Head. The latter appears to relate to the work of an artist with no connection to plaintiff and plaintiff has not demonstrated how its trademark could be confused with the latter work. Plaintiff can refile with additional argument in support of the request, and counsel must appear to present any re-noticed motions. Mailed notice. |
