| 01/03/2024 | DEFAULT Judgment Order Signed by the Honorable Joan B. Gottschall on 1/3/2024. Mailed notice |
| 01/03/2024 | MINUTE entry before the Honorable Joan B. Gottschall: The deadline of 12/14/2023 to object to plaintiff's motion for entry of default and default judgment has come and gone (see No. [22]), and no objection has been filed. Upon consideration of plaintiff's supplement [27] filed 12/27/2023, plaintiff's motion (No. [21]) for entry of default and default judgment is granted. Enter default judgment. Civil case terminated. Mailed notice |
| 12/28/2023 | ANNUAL REMINDER: Pursuant to Local Rule 3.2 (Notification of Affiliates), any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. This minute order is being issued to all counsel of record to remind counsel of their obligation to provide updated information as to additional affiliates if such updating is necessary. If counsel has any questions regarding this process, this LINK will provide additional information. Signed by the Executive Committee on 12/28/2023: Mailed notice. |
| 12/27/2023 | SUPPLEMENT to motion for default judgment[21] 附件: 1:Exhibit 3 2:Exhibit 2 3:Exhibit 1 |
| 12/20/2023 | MINUTE entry before the Honorable Joan B. Gottschall: As exhibits to its supplemental memorandum, plaintiff submits a screenshot [24-1] of Amazon.com buyer feedback for its products and two declarations (doc. Nos. [24-2] and [24-3]). The supplemental evidence plaintiff has submitted does not permit the court to evaluate the nature and extent of defendants' trademark infringement, as required by the order [23] entered 11/30/2023. In similar cases, the plaintiff typically files screenshots showing the accused products so the court can compare plaintiff's trademarks with the accused products, and determine whether an adequate basis in the record exists for finding willful infringement. See generally AutoZone, Inc. v. Strick, 543 F.3d 923, 929-30 (7th Cir. 2008). No screenshots of the accused products or other evidence from which such a comparison can be performed has been filed. Although it was not required to do so, the court attempted to view the accused products using the URLs listed in Schedule A [1-2] to the complaint, but each URL led to temu.com's homepage. Plaintiff is instructed to file screenshots or other evidence permitting a comparison of plaintiff's marks and the accused products as soon as possible and in any event by 12/27/2023. Mailed notice |

Plaintiff's counsel is instructed to email a proposed order authorizing the specific discovery it is requesting to Proposed_Order_Gottschall@ilnd.uscourts.gov. The proposed order must be sent in Word and PDF formats. Plaintiff's motion [4] for leave under Fed. R. Civ. P. 4(f)(3) to serve the summons and complaint by electronic means is denied without prejudice as premature. Plaintiff has not demonstrated that it exercised reasonable diligence to determine defendants' mailing addresses, as this court held is required to render the Hague Service Convention, 20 U.S.T. 361, inapplicable in Luxottica Group S.p.A. v. Partnerships & Unincorporated Associations Identified on Schedule "A", 391 F. Supp. 3d 816, 819-27 (N.D. Ill. 2019). Nor has plaintiff made any argument in support of revisiting Luxottica's holding. See ECF No. 4 at 6-7. The court considered the cases cited on pages 6-7 of plaintiff's motion in Luxottica and found them unpersuasive. See Luxottica, 391 F. Supp. 3d at 821-27 & n.7. Mailed notice |
