11/07/2023 MINUTE entry before the Honorable Thomas M. Durkin: On October 5, 2023, this Court entered a Preliminary Injunction Order (Dkt. No. 27) wherein various defendants, including defendant Healthy and Active (Defendant No. 13), were restrained from performing certain activities related to the sale of male chastity devices. Through the Preliminary Injunction Order, Amazon.com ("Amazon") was instructed to, among other things, place restraints on all internet store accounts owned by the defendants, including defendant Healthy and Active. On October 19, 2023, the Plaintiff and Healthy and Active entered into a written Settlement Agreement and General Release (the "Settlement Agreement"). Pursuant to the Settlement Agreement, Healthy and Active paid settlement funds to the Plaintiff, and the Plaintiff dismissed this action as against Healthy and Active. The Plaintiff filed a Notice of Voluntary Dismissal dismissing Healthy and Active from this action on October 24, 2023. (Dkt. No. 48). In light of the Settlement Agreement and Plaintiff's voluntary dismissal of Healthy and Active from this action, IT IS ORDERED that: (i) this action, as against Healthy and Active, is dismissed; (ii) the injunction entered against Healthy and Active on October 5, 2023, is no longer operable against Healthy and Active; (iii) Amazon is permitted and instructed to release all restraints that it placed on the internet store accounts owned by Healthy and Active forthwith; and (iv) Amazon is to provide Healthy and Active with full access to its internet store accounts forthwith.
