At the very least, Defendant Cosplay has demonstrated that it is questionable whether electronic service was accomplished as the Court previously ordered. As to the question of personal jurisdiction, taking Plaintiff's allegation that Cosplay has conducted a minimal amount of business in Illinois as true, there would appear to be a genuine dispute as to whether those contacts support exercising jurisdiction. This is true even if Cosplay's only sale in Illinois was a sale to Plaintiff's counsel. This would appear to be enough for a prima facie showing that Plaintiff's claim regarding jurisdictional contacts with Illinois. To support the exercise of specific jurisdiction, a suit "must arise out of or relate to the defendant's contacts with the forum," but the relationship need not be strictly causal. Ford Motor Co. v. Mont. Eighth Jud. Dist. Ct., 592 U.S. 351, 359-62 (2021) (cleaned up). The key is foreseeability: "potential defendants should have some control overand certainly should not be surprised bythe jurisdictional consequences of their actions." Tamburo v. Dworkin, 601 F.3d 693, 701 (7th Cir. 2010) (cleaned up). The parties are to confer and propose a fact discovery schedule by October 15, 2024. This assumes that Defendant does not wish to file an answer now and instead wishes to pursue the jurisdictional question raised in its brief. Accordingly, the fact discovery schedule the parties propose should account for time to conduct jurisdictional discovery and the Court will set any appropriate motion schedule following the close of all fact discovery.
