| 02/14/2025 | MINUTE entry before the Honorable Jeffrey I Cummings: The parties' joint motion for entry of a stipulated final judgment and injunction order 132 is granted. The Court strikes paragraph no. 9 from the parties' proposed stipulated final judgment and injunction order. Where, as here, the Court issues "an injunction, it automatically retains jurisdiction to enforce it." United States v. Fisher, 864 F.2d 434, 436 (7th Cir. 1988). "Therefore, a provision purporting to preserve the district court's jurisdiction is superfluous, and risk[s] future confusion as to our jurisdictionwhere confusion is least tolerable." R2X, LLC v. Windsor, No. 1:23-CV-01568-SEB-MKK, 2024 WL 4008495, at *2 (S.D.Ind. Aug. 30, 2024) (cleaned up). Enter Stipulated Final Judgment and Injunction Order (as modified). All pending deadlines and hearings are stricken. Civil case terminated. Mailed notice |

| 02/05/2025 | MINUTE entry before the Honorable Jeffrey I Cummings: The Court has reviewed the parties' joint status report 130, which indicates that the remaining parties have reached a settlement and are in the process of finalizing the terms in writing. Accordingly, defendants' request for extension of time to answer or otherwise plead 129 is granted. Defendants' deadline to answer or otherwise plead is stayed unless otherwise ordered by the Court. If the parties have not filed their joint stipulation to dismiss by 3/10/25 they shall file a joint status report on settlement on that date. The 2/7/25 tracking status hearing is stricken and re-set to 3/21/25 at 9:00 a.m. (to track the case only, no appearance is required). Mailed notice |

If this matter is not resolved, the remaining defendants shall answer or otherwise plead by 1/31/25. In light of the parties' representation that there is a "high likelihood" of resolving this matter without further court intervention, defendants' motion for referral to the register of copyrights 62 is terminated without prejudice with leave to renew as appropriate. The 1/10/25 joint status report deadline is stricken and re-set to 1/31/25. The 1/17/25 tracking status hearing is stricken and re-set to 2/7/25 at 9:00 a.m. (to track the case only, no appearance is required). Mailed notice |

An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. This minute order is being issued to all counsel of record to remind counsel of their obligation to provide updated information as to additional affiliates if such updating is necessary. If counsel has any questions regarding this process, this LINK will provide additional information. Signed by the Honorable Virginia M. Kendall on 12/27/2024: Mailed notice. |

| 10/29/2024 | DEFAULT JUDGMENT ORDER Signed by the Honorable Jeffrey I Cummings on 10/29/2024. Mailed notice |
| 10/29/2024 | MINUTE entry before the Honorable Jeffrey I Cummings: Defaulting defendant nos. 30, 31, 32 and 33 have not responded to plaintiff's motion for entry of default judgment. Accordingly, the motion 82 is granted as to defendant nos. 30, 31, 32 and 33. Based on the evidence previously submitted by plaintiff and the admission of liability by virtue of the default, plaintiff has established that a permanent injunction should be entered. The infringement of plaintiff's copyrights irreparably harms plaintiff and confuses the public. This infringement was willful and statutory damages are awarded. After considering the nature of the products, the price point, the absence of any concrete evidence of lost profits or high-volume infringement by the defaulting defendants (plaintiff has failed to seek an accounting of profits), the value of plaintiff's brand, and the need to deter infringement that is easily committed and difficult to stop, the Court concludes that $30,000 is an appropriate award of statutory damages. Enter Default Judgment Order as to defendant nos. 30, 31, 32 and 33 only. Mailed notice |
| 10/24/2024 | DECLARATION of Deepa A. Chari regarding text entry, 103, text entry, 107 of service of minute order 附件: 1:(Exhibit 1 - Service email) |
| 10/23/2024 | MINUTE entry before the Honorable Jeffrey I Cummings: The docket does not reflect that plaintiff provided notice of this Court's 9/27/24 order 103 to defendant No. 33, which was defaulted by this Court's 10/3/24 amended order 107. If plaintiff has in fact provided such notice, it shall file a certificate reflecting that notice by 10/24/24. If plaintiff did not previously provide notice to defendant no. 33, it shall provide a copy of the Court's orders 103 107, along with a copy of this order, to advise defendant no. 33 that any objections to the motion for entry of default judgment must be filed on or before 10/31/24. If no objections are filed by that date, the Court will consider the motion unopposed. Plaintiff must serve this minute order upon defendant no. 33 within one business day of its entry on the docket and must promptly file proof of that service. Mailed notice |
| 10/23/2024 | PRELIMINARY INJUNCTION ORDER Signed by the Honorable Jeffrey I Cummings on 10/23/2024. Mailed notice |
| 10/23/2024 | MINUTE entry before the Honorable Jeffrey I Cummings: The Court has reviewed the parties' joint status report 112 and orders as follows. (1) First, this Court's 9/27/24 opinion 101 and order 102 are amended to reflect that the non-appearing defendants at that time did not include defendant nos. 16 and 27, which have appeared through counsel in this matter. Moreover, defendant nos. 15 and 21 have been dismissed. Accordingly, this Court enters the preliminary injunction as to defendant nos. 30, 31, 32, and 33 only. Enter Preliminary Injunction Order; (2) By agreement of the parties, the TRO entered in this case and previously converted to a preliminary injunction by way of the Court's 1/2/24 order 25 will remain in effect until the resolution of this case as to defendant nos. 1, 2, 4, 6, 7, 11, 16, 18, 19, 20, 22, 26, 27, and 29; (3) defendants' motion for leave to file supplemental information 96 is granted. However, any further briefing regarding that supplemental information is stayed pending further order of the Court to allow the remaining parties to engage in continued settlement negotiations; and (4) By 12/6/24, the parties shall file a joint status report on their ongoing settlement negotiations as to defendant nos. 1, 2 and 6, and the status of dismissal paperwork as to any remaining defendants at that time. The parties shall also indicate whether they are mutually interested in participating in a settlement conference with the assigned Magistrate Judge. The 11/4/24 tracking status hearing is stricken and re-set to 12/16/24 at 9:00 a.m. (to track the case only, no appearance is required). Mailed notice |

| 01/02/2024 | MINUTE entry before the Honorable Jeffrey I Cummings: Before the Court is plaintiff's motion for entry of a preliminary injunction 21. In connection with that motion, plaintiff must serve all remaining defendants with the following statement: "The Court has taken the motion for a preliminary injunction under advisement and will consider the motion unopposed if no defendant appears and objects by or before January 10, 2024." If no objections are filed by that date, the Court will consider the motion unopposed. Plaintiff must serve this minute order upon all remaining defendants within one business day of its entry on the docket and must promptly file proof of that service. For the reasons stated in the Court's order entering the TRO, the TRO is extended to and including the date upon which the Court adjudicates the motion for a preliminary injunction. See H-D Mich., LLC v. Hellenic Duty Free Shops S.A., 694 F.3d 827, 843-45 (7th Cir. 2012). Because this extension exceeds the maximum duration for a TRO under Fed.R.Civ.P. 65(b), this extension "becomes in effect a preliminary injunction that is appealable, but the order remains effective." As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. | 12/05/2023 | TEMPORARY RESTRAINING ORDER Signed by the Honorable Jeffrey I Cummings on 12/5/2023. Mailed notice Modified on 12/21/2023. |
| 12/05/2023 | MINUTE entry before the Honorable Jeffrey I Cummings: This case has been assigned to the calendar of Judge Jeffrey I. Cummings. Plaintiff's motions for leave to file under seal 4 8 and ex parte motion for a temporary restraining order 9, including a temporary injunction, a temporary asset restraint, expedited discovery, and electronic service of process, are granted. Plaintiff's submissions establish that, were defendants to learn of these proceedings before the execution of plaintiff's requested preliminary injunctive relief, there is a significant risk that defendants could destroy relevant documentary evidence and hide or transfer assets beyond the reach of the Court. Accordingly, subject to unsealing at an appropriate time, plaintiff may file under seal the documents identified in the motions to seal. The Temporary Restraining Order being entered along with this minute order shall also be placed under seal. In addition, for the purpose of the motions cited above, plaintiff's filings support proceeding on an ex parte basis at this time. Specifically, and as noted above, were defendants to be informed of this proceeding before a TRO could issue, the Court finds that it is likely that their assets and websites would be redirected, thus defeating plaintiff's interests in identifying defendants, stopping defendants' infringing conduct, and obtaining an accounting. In addition, the evidence submitted by plaintiff shows a likelihood of success on the merits (including evidence of active infringement and sales into Illinois), that the harm to plaintiff is irreparable, and that an injunction is in the public interest. An injunction serves the public interest because of the consumer confusion caused by counterfeit goods, and there is no countervailing harm to defendants from an order directing them to stop infringement. Electronic service of process does not violate any treaty and is consistent with due process because it effectively communicates the pendency of this action to defendants. Expedited discovery is warranted to identify defendants and to implement the asset freeze. Enter Sealed Temporary Restraining Order. Status hearing is set for 12/29/23 at 9:00 a.m. (to track the case only, no appearance is required). Mailed notice |
