Valderrama: The Court is in receipt of Defendant Ya Ya Creations, Inc.'s Declarations in support of its request for reimbursement of attorneys' fees and costs [71]. In its Declarations, Defendant Ya Ya Creations, Inc. takes issue with the Court's finding that "Ya Ya Creations does not include any evidence that Plaintiff knew of any affiliation between Ya Ya Creations and these two named Defendants in this action to support its theory of misconduct." R. 63. By way of background, the Court ordered Plaintiff to file a response to Defendant Ya Ya Creations' update concerning its request for reimbursement due to illegitimate ex parte motion for temporary restraining order [46] addressing Defendant Ya Ya Creations, Inc.'s requested reimbursement, by 11/22/2023, which Plaintiff did [56], and the Court did not allow for a reply by Defendant Ya Ya Creations, Inc. in setting that briefing schedule. R. 63. However, Defendant Ya Ya Creations, Inc. includes further argument on the update concerning its request for reimbursement in the Declarations. The Court reminds the parties that it required Defendant Ya Ya Creations, Inc. to file a Declaration which included itemizations for claimed lost interest, reasonable attorneys' fees, and costs, incurred in connection with returning Ya Ya Creation to the status quo in this matter only, and the Court's order did not solicit further argument on whether Plaintiff was aware of Defendant Ya Ya Creations, Inc.'s affiliation with efavormart and tableclothsfactory before filing this lawsuit. Thus, the Court will not address Defendant Ya Ya Creations, Inc.'s further argument on this point in resolving the reimbursement amount. Valderrama: The Court has reviewed Defendant Ya Ya Creations, Inc.'s update concerning its request for reimbursement due to illegitimate ex parte motion for temporary restraining order [46] and the response and declaration filed by Plaintiff [56][57]. In its Minute Entry ordering briefing on the pending motion for reimbursement [49] the Court ordered Plaintiff to identify Defendant Ya Ya Creation's Defendant number as listed on its original Schedule A. Based on Plaintiff's response, the Court understands that Ya Ya Creation is not a named Defendant in this action, and that the named Defendants in this action efavormart (Defendant No. 195) and tableclothsfactory (Defendant No. 197) are operated by Ya Ya Creations. In support of its response, Plaintiff includes communications between the parties which evidence Plaintiff's actions informing third-parties to lift the restraints on efavormart and tableclothsfactory once it was informed those entities were operated by Ya Ya Creations, and copies of efavormart and tableclothsfactory's webpages which do not indicate any affiliation with Ya Ya Creations. In its motion, Ya Ya Creations does not include any evidence that Plaintiff knew of any affiliation between Ya Ya Creations and these two named Defendants in this action to support its theory of misconduct. Nevertheless, the Court finds the case cited by Ya Ya Creations, Bestway Inflatable & Material Corp. v. The Individuals, Corporations, Limited Liability Companies, Partnerships, and Unincorporated Associations Identified on Schedule A Hereto, 1-23-cv-02286 (N.D Ill. Nov. 8, 2023), instructive. In that case, defendants filed a motion for injunction bond arguing it was wrongfully enjoined. Plaintiff dismissed the defendants instead of substantively responding to the defendants' arguments opposing the preliminary injunction motion. The court found that the plaintiff had conceded the relevant facts under Federal Rule of Civil Procedure 65(c) that the subject defendants were wrongfully enjoined by dismissing them instead of substantively responding to their opposition to the motion for preliminary injunction. Here, the Court is presented with a similar fact pattern in that Plaintiff dismissed Defendants efavormart and tableclothsfactory once it learned of their affiliation with Ya Ya Creation, who Plaintiff is in active litigation with in a different federal district court. In the Seventh Circuit, "a prevailing defendant is entitled to damages on the injunction bond unless there is a good reason for not requiring the plaintiff to pay in the particular case." Coyne-Delany Co. v. Cap. Dev. Bd. of State of Ill., 717 F.2d 385, 391 (7th Cir. 1983); see also Triumph v. Ward, 2011 WL 6754044 (N.D. Ill. Dec. 22, 2011). Here, in effect, Plaintiff concedes that it wrongfully named efavormart and tableclothsfactory, and dismissed them from this action. Plaintiff has not provided sufficient reason for not requiring payment to Ya Ya Creation based on the circumstances presented in this case. Based on the briefing, and in its discretion, the Court grants Ya Ya Creation's motion for reimbursement in returning Ya Ya Creation to the status quo. By 12/04/2023, Ya Ya Creation must file a declaration, including itemizations for claimed lost interest, reasonable attorneys' fees, and costs, incurred in connection with returning Ya Ya Creation to the status quo in this matter.
