04/22/2025 PAPERLESS ORDER granting in part 6 Plaintiff's Motion for Leave to File under Seal Certain Documents Containing Identifying Information About the Defendants and Proceed under True Party Name ("Motion"). On April 8, 2025, the Court entered an Omnibus Order Regarding Schedule "A" Causes of Action ("Order"), [ECF No. 6]. The Order requires Plaintiff to refile any previously pending motions within fourteen (14) days in compliance with the requirements of the Order. The Order also explains that "[m]otions to file documents under seal or to proceed anonymously or pseudonymously in these cases are disfavored by the Court," and any such motion will "be denied with leave to refile only after all the requirements of this Order have been complied with and only once the exceptional circumstances required to grant such a motion have been shown." Order at 4-5. The Motion requests that the Court instruct the Clerk to change the case caption to reveal Plaintiff's true identity, Maratac, Inc., because Plaintiff does not intend to proceed pseudonymously. Id. at 7. The Motion also requests leave for Plaintiff to refile its previously pending motions and certain related documents under seal. Id. at 3-7. The Motion argues that Plaintiff cannot comply with the Order before being granted leave to file under seal because compliance with the Order would require Plaintiff to identify specific Defendants or to reveal Defendants' identities by name. Id. However, nothing in the Order requires Plaintiff to divulge the names of individual Defendants. To the extent Plaintiff believes compliance with the Order will incidentally reveal Defendants' identifying information, Plaintiff may, for example, omit or redact any information that it believes would identify any individual Defendant. Plaintiff may also, to the extent necessary, identify any individual Defendant by number corresponding to Schedule "A" to the Amended Complaint, which Plaintiff may request to file under seal after it has complied with the Order. Should Plaintiff require additional time to comply with the Order, it may request an extension by separate motion. Accordingly, Plaintiff's request for leave to file under seal is DENIED and Plaintiff's request to proceed under true party name is GRANTED. The Clerk of Court is DIRECTED to change the case caption to Maratac, Inc. v. The Individuals, Partnerships, and Unincorporated Associations Identified on Schedule "A". Signed by Judge Rodolfo A.
