For the reasons stated on the record, with respect to MHMY's counterclaim, the Court grants Plaintiff's motion to dismiss [142] [144] as to Count 4-5 (fraud on the patent office), without prejudice. The Court allows Counts 1-3 (anti-trust and tortious interference) to proceed. The Court grants MHMY's motion for alternative service of process on the third-party defendants [69]. Third party defendants' motion for sanctions against MHMY for filing the counterclaims [143] is denied. The third-party defendants are not yet parties or subject to the court's jurisdiction. There is no basis for sanctions. AOCAN's motion to for joinder [56] is granted, without objection. AOCAN's motion for sanctions [87] is granted in part. The Court agrees that the TRO was improperly lodged against AOCAN on 3/15/24 when AOCAN was not a defendant in this case. But a TRO apparently would have been lodged against AOCAN based on the case pending in the middle district of Florida on 3/29/24. Assuming AOCAN was not subject to an unrelated injunction, AOCAN should be awarded lost profits from this time period. Parties are to review the documents and attempt to agree on the damages arising from this incident. Plaintiff's motion for default against Neodrop [170] is granted. Plaintiff shall provide an order to the court's proposed order box by 12/5/24. Between now and 12/20/24, Plaintiff is to have at least 3 calls with defendant Guangzhou Kobe Information Technology in an effort to resolve this matter. As indicated at the last status hearing, all items previously filed under seal are to be unsealed by the Clerk's office. Plaintiff reported on its decision to file two separate cases, one in the Northern District of Illinois and the other in the Middle District of Florida, on the day he filed the cases. There was no rational basis to file two cases or to decide what defendant to name in which case. That is a waste of judicial resources and has led to confusion. Plaintiff is strongly encouraged to voluntarily consolidate these cases into one matter, something it should have done from the start. The Court has reviewed the status report Plaintiff filed by 5/10/24 as directed. [82]. There are 12 defendants remaining in the case. Three are pending resolution (17, 22 and Shein.com No.1).
