| 01/12/2023 | MINUTE entry before the Honorable Steven C. Seeger: On January 10, 2023, this Court directed Plaintiff to submit a Word version of a proposed judgment to the proposed order inbox. (Dckt. No. 52) Counsel later did so. Unfortunately, the draft judgment does not comply with the requirements of a judgment under Rule 58 as articulated by the Seventh Circuit. The proposed judgment refers to the amounts "set forth in the 'Reasonable Royalty Rate' column from Exhibit D to the Gross Declaration." But a judgment must be self-contained, meaning that it must not incorporate by reference the contents of some other document. See Otis v. City of Chicago, 29 F.3d 1159 (7th Cir. 1994); Bethune Plaza, Inc. v. Lumpkin, 863 F.2d 525 (7th Cir. 1988). A party must be able to read a judgment as a stand-alone document and know what the district court has ordered. The proposed judgment also includes a sentence that purports to impose a permanent injunction. But the Seventh Circuit has interpreted Rule 65 to require that injunctions appear in a separate document (that is, separate from the judgment itself). See MillerCoors LLC v. Anheuser-Busch Companies, LLC, 940 F.3d 922 (7th Cir. 2019). So, counsel must try again. A revised draft of a proposed is due by January 18, 2023.
