Neither the plaintiffs' motion nor its supporting documents expressly identify which, if any, defendants have received notice in accordance with Fed. R. Civ. P. 65(a)(1). The plaintiffs assert that "dozens of. accounts owned by the [defendants] have been frozen," (ECF No. 27, p.2), but this does this constitute adequate service. The plaintiffs declare that notice has been sent to "the email addresses identified in Exhibit 1 to the Declaration of Marc Muraccini," (ECF No. 29, 2), but that exhibit is nothing but the plaintiffs' trademark registrations (ECF No. 11-2). Even if the declaration meant to reference Exhibit 2, Exhibit 2 does not readily identify any email addresses (ECF Nos. 12-18). Finally, the plaintiffs also declare that notice has been sent to "any email addresses provided for Defendants by third parties," (ECF No. 29, 2), but this too does not identify which defendants' emails were provided, if any. Accordingly, the plaintiffs are afforded leave to file a declaration of service--expressly indicating which defendants have received proper service--along with a renewed motion for preliminary injunction.
