Plaintiff's counsel confirms that plaintiff is withdrawing the motion for a preliminary injunction as to defendants with counsel who properly objected to the motion. For the reasons stated in open court, the motion for preliminary injunction 34 is granted in part. The motion is unopposed as to defendants who did not appear at the hearing, but the court concludes that the balance of harms tips in favor of all defendants with respect to an asset restraint. The court further concludes that an injunction prohibiting infringement causes no harm to defendants, but that plaintiff has a low likelihood of success in prevailing on a theory that use of the word Unicorn, in any manner, is infringing. Enter Preliminary Injunction Order. Plaintiff is ordered to advise all third-party platforms and processors that the asset freeze has been lifted. Upon further review, the court also concludes that preliminary injunctive relief against defendant Craftman Courtyard is not appropriate because the balance of harms to that defendant outweighs the harm to plaintiff. Finally, in response to plaintiff's comment that each defendant must be considered separately, the court wonders whether joinder is appropriate and whether plaintiff inappropriately named 88 defendants in a single complaint. If any defendant were to object to joinder, the court would take a fresh look at whether all remaining defendants should be severed and plaintiff required to pay a filing fee for each defendant. The Clerk is directed to unseal any previously sealed documents in this matter. Plaintiff's counsel is directed to add all defendants listed on Schedule A to the court's docket within three business days. The plaintiff's written submissions establish that if defendants were informed of this proceeding before a TRO could issue, assets would likely be redirected, defeating plaintiff's interests in identifying defendants, stopping the infringement, and obtaining an accounting. In addition, the submitted evidence establishes a likelihood of success on the merits (albeit not a strong one, given the court's concerns that uses of the word Unicorn may not be infringing), the harm to plaintiff is irreparable and an injunction is in the public interest because infringement interferes with the plaintiff's ability to control its intellectual property. Those rights cannot be fully compensated by money damages. There is no countervailing harm to defendants from an order directing them to stop infringement. Electronic service of process does not violate any treaty and is consistent with due process because it is an effective, perhaps the most effective, way to communicate with defendants. Expedited discovery is warranted to identify defendants and implement the asset freeze. If any defendant were to appear and object, the court will take a fresh look at the asset freeze, joinder, and personal jurisdiction. The court finds that security in the amount of $50,000 is sufficient to secure the injunctive relief. The asset freeze is limited to $10,000, and may be reduced further if the freeze unnecessarily interferes with defendants' ability to conduct other business. Enter Sealed Temporary Restraining Order.
