Gottschall: Plaintiff devotes much of its supplemental memorandum of law 58 in support of its motion 51 for default judgment to arguing an issue on which the court did not request supplemental briefing, namely plaintiff's entitlement to statutory damages. See Suppl. Mem. 4-9. Regarding the issue on which supplemental briefing was requested, plaintiff argues that permanently freezing defendant's assets is appropriate "to prevent the continued harm bestowed upon Plaintiff as a result of Defendant's illegal activities of marketing and selling counterfeit NARUTO Products." Suppl. Mem. 3; see id. at 5-6. Consistent with Grupo Dataflex Grupo Mexicano de Desarrollo S.A. v. Alliance Bond Fund, Inc., 527 U.S. 308 (1999), this court froze defendant's assets pre-judgment to preserve plaintiff's ability to conduct an equitable accounting of profits from infringing sales. Now that plaintiff has elected statutory damages, the extraordinary relief of a permanent asset freeze has not been justified. Accordingly, plaintiff's motion 51 for default judgment is granted with the exception of the request for a permanent asset freeze. The default judgment must maintain the preliminary injunction's asset freeze not to exceed the amount of statutory damages awarded in the default judgment. Plaintiff must file a revised proposed default judgment on the docket by and including April 24, 2025.
