12/18/2020 MINUTE entry before the Honorable John Z. Lee: Status hearing held on 12/16/20. On the record, the Court mistakenly granted Plaintiff's motion for a temporary restraining order 10 as to thirty-one defendants. The Court entered that ruling in error, which was intended for docket number 20-cv-06550; as such, that ruling is vacated. Nonetheless, upon review of Plaintiff's memorandum in support of joinder, the Court agrees that joinder is proper for the following fifteen defendants, as identified by their corresponding line numbers on the sealed Schedule A: Nos. 62, 63, 64, 65, 66, 67, 68, 69, 70, 71, 72, 74, 75, 76, and 77. Plaintiff states that these fifteen defendants not only sell virtually identical counterfeit products, but do so through similarly designated e-commerce storefronts, using similar product descriptions and photos. See Mem. Supp. Joinder at 311, ECF No. 21 (screenshots of relevant defendants' e-commerce storefronts). These circumstances suffice to create a plausible inference that their allegedly infringing conduct is "logically related," Mosely v. Gen. Motors Corp., 497 F.2d 1330, 1333 (8th Cir. 1974), and not simply parallel, see 6/22/20 Order, Este Lauder Cosmetics Ltd. v. The P'ships and Unincorporated Ass'ns Identified on Schedule "A," No. 20 C 845 (N.D. Ill.) (Lee, J.), ECF No. 40. Thus, joinder is permitted as to these fifteen defendants, and the remaining 109 defendants are dismissed sua sponte. A motion hearing on Plaintiff's motion for a temporary restraining order 10 is set for 12/22/20 at 8:45 a.m.In light of the COVID-19 pandemic and the related General Orders, the Court finds that it is necessary to conduct the status hearing via telephone conference.
