Lee: Plaintiff Valentino Rossi has filed this suit alleging trademark infringement and related claims against 232 e-commerce store operators believed to reside in foreign jurisdictions. Given that large number of Defendants, the Court instructed Plaintiff to file a memorandum of law showing why their joinder is appropriate under Rule 20(a)(2). Upon review of Plaintiff's memorandum in support of joinder, the Court agrees that joinder is proper for the following three defendants, as identified by their corresponding line numbers on the sealed Schedule A: Nos. 11, 13, and 46. Plaintiff states that these defendants not only sell virtually identical counterfeit products, but do so through similarly designated e-commerce storefronts, using similar product descriptions and photos, and selling the products for similar prices. See Mem. Supp. Joinder at 23 29 ; Ex. AA 30 (screenshots of relevant defendants' e-commerce storefronts). These circumstances suffice to create a plausible inference that their allegedly infringing conduct is "logically related," Mosely v. Gen. Motors Corp., 497 F.2d 1330, 1333 (8th Cir. 1974), and not simply parallel, see 6/22/20 Order, Este Lauder Cosmetics Ltd. v. The P'ships and Unincorporated Ass'ns Identified on Schedule "A," No. 20 C 845 (N.D. Ill.) (Lee, J.), ECF No. 40. Thus, joinder is permitted as to these fifteen defendants, and the remaining 229 defendants are dismissed sua sponte. Mailed notice |
