02/05/2021 MINUTE entry before the Honorable Steven C. Seeger: On January 25, 2021, Defendant Azzker filed a motion to dismiss. (Dckt. No. 50) Since then, Plaintiff has filed three Notices of Voluntary Dismissal, plus a Joint Stipulation and Order of Dismissal (as an aside, the latter filing did not comply with Rule 41(a)(1)(A)(ii)). When reviewing the docket, the Court figured out on its own that the motion to dismiss is now moot because one of the dismissed Defendants was Azzker, the movant. (Dckt. 65) Plaintiff failed to call the Court's attention to the fact that the motion to dismiss is now moot because Plaintiff was dismissing the claims against the movant. Unceremoniously including the movant in one of several lists of dismissed Defendants is not adequate. It forces the Court to go through each Notice, one by one, Defendant by Defendant, and figure out if it impacts any pending motion. Going forward, if Plaintiff seeks dismissal of a Defendant that filed a pending motion, Plaintiff's counsel must file a freestanding docket entry that calls the Court's attention to the fact that the motion is moot. This directive extends to any other Schedule A case, too. A "Notice of Mooted Motion," or "Notice that the Motion to Dismiss Is Moot," or something along those lines, should do the job. The motion to dismiss (Dckt. No. 50) is denied as moot. Mailed notice

12/16/2020 MINUTE entry before the Honorable Steven C. Seeger: In connection with the motion for a temporary restraining order, the Court received a Word version of a proposed order. The draft posed a number of formatting challenges and, to put it mildly, needed a considerable amount of tender loving care from a typographical standpoint (not to mention substance). As an example, the first sentence on page 2 stated that an injury "will occur to the Plaintiff, will occur from the sale." As a second example, the next sentence stated that "[t]here is good cause to for issuing this Order." As a third example, the section headings jumped from Roman "IV" to Roman "X," skipping Roman "V" to Roman "IX" in their entirety. As a fourth example, the draft said that Schedule A was "attached hereto," but the document did not include Schedule A (i.e., it should have appeared in the Word file). As a final (non-exhaustive) example, the formatting of the subheadings was scrambled on page five (some are indented, and others are not). The draft was unkempt and not ready for prime time. Fixing the draft consumed considerable time by the Court, time that the Court should not have to spend fixing Plaintiff's draft. A redline is attached. Going forward, in any future case, Plaintiff's counsel must submit a more polished draft that it is free of formatting issues and that incorporates the considerable changes that this Court made in the case at hand. Continuing to use the generic draft that the Court received, and simply plugging in the names of new clients in future Schedule A changes, is not a viable option. A failure to comply with this Order may lead to denial of the motions, and/or may delay any relief from this Court. Mailed notice. That filing violated Local Rule 26.2(b), which requires Court approval to file documents under seal. "No attorney or party may file a document under seal without order of court." See Local Rule 26.2(b). A party can provisionally file a document under seal when filing a motion to seal "before or simultaneously" with the sealed document, see Local Rule 26.2(c), but Plaintiff filed no such motion. "Any document filed under seal without such a sealing motion may be stricken by the court without notice." Id. Plaintiff also violated the Federal Rules by filing a complaint that failed to identify the Defendants, without seeking leave of court to file against an anonymous group. Federal Rule 10(a) provides that the "title of the complaint must name all the parties." See Fed. R. Civ. P. 10(a). The complaint raises claims against the Defendants listed on the (sealed) Schedule A, meaning an undisclosed list that the public cannot see. So, as things stand, the public has no idea who Plaintiff sued, and Plaintiff did not request permission to shield that information from the public. The complaint (Dckt. No. [1]) and the sealed Schedule A (Dckt. No. [6]) are hereby stricken. Mailed notice
