The case before this Court was filed in November 2023 and a preliminary injunction was issued more than a month ago [see [105]]. By all accounts, default judgment is the next and final step in this case (not formal discovery, as suggested by the motion.) Conversely, Case no. 24-cv-6736 was filed less than two weeks ago against 130 defendants. A brief review of the list of defendants in the 24-cv-6736 case suggests that they are much different than the defendants in the instant case. And the judge in the 24-cv-6736 case has raised a question concerning the propriety of joinder. More broadly, it is not unusual to have one Plaintiff proceed in multiple "Schedule A" cases against multiple defendants. At a minimum, it cannot be said that the third requirement for reassignment under LR 40.4 is satisfied because this case has "progressed to the point where designating a later filed case as related would be likely to delay the proceedings in the earlier case substantially."
